Terms of Service

These Terms of Service ("Terms") govern the use of the SkillQuest Shopify application ("Service").
By installing or using the Service, you agree to these Terms.
1. Description of the Service
SkillQuest provides a gamified discount widget that merchants can display on their Shopify storefront.
The Service may allow merchants to collect visitor email addresses and integrate with marketing platforms including Klaviyo and Mailchimp.
2. Merchant Responsibilities
Merchants are responsible for ensuring that their use of the Service complies with applicable laws, including:
- data protection laws
- privacy laws
- email marketing regulations such as GDPR and CAN-SPAM
Merchants must obtain appropriate consent before collecting email addresses or sending marketing communications.
3. Third-Party Services
The Service may integrate with third-party platforms including:
- Shopify
- Klaviyo
- Mailchimp
Use of these services is subject to their respective terms and privacy policies.
We are not responsible for the practices or policies of third-party platforms.
4. Billing and Payments
All charges for the Service are processed through the Shopify Billing API.
Subscription fees, plan upgrades, and usage charges are managed entirely through Shopify's billing system. We do not collect, process, or store payment card information directly.
Billing terms, refund policies, and payment disputes are subject to Shopify's Terms of Service.
5. Acceptable Use
You agree not to use the Service to:
- collect personal data unlawfully
- send unsolicited or unlawful marketing communications
- violate privacy laws
- interfere with the operation of the Service
We may suspend or terminate access for violations of these Terms.
6. Availability
We aim to maintain reliable service but cannot guarantee uninterrupted availability.
The Service may be modified, suspended, or discontinued at any time.
7. Limitation of Liability
To the maximum extent permitted by law, SkillQuest shall not be liable for:
- indirect or consequential damages
- loss of profits
- loss of business or revenue
- loss of data
arising from the use of the Service.
8. Disclaimer
The Service is provided "as is" without warranties of any kind.
We do not guarantee marketing results, conversion rates, or revenue outcomes.
9. Termination
Merchants may terminate use of the Service at any time by uninstalling the app from their Shopify store.
Upon uninstallation:
- Any active subscription is automatically cancelled through the Shopify Billing API
- Access to the store's data is immediately revoked by Shopify
- Session data is deleted immediately
- All remaining merchant data (configurations, analytics, collected emails, issued discount codes) is deleted when Shopify issues the shop data erasure request, typically within 48 hours
We may suspend or terminate access if these Terms are violated. In such cases, the same data deletion process applies.
10. Governing Law
These Terms shall be governed by the laws of the applicable jurisdiction in which the service provider operates, unless otherwise required by law.
